1 · Oor hierdie bepalingsAbout these terms
Hierdie bepalings reël jou gebruik van stemme.co.za en enige bestelling wat jy plaas. Deur te bestel, aanvaar jy hulle. Twee mense is betrokke: die koper wat betaal, en die verteller wie se stem die boek word — dikwels nie dieselfde persoon nie. Niks hierin verminder jou regte onder die Verbruikersbeskermingswet, 68 van 2008 ("VBW") of enige ander dwingende wet nie.These terms govern your use of stemme.co.za and any order you place. By ordering, you accept them. Two people are involved: the buyer who pays, and the storyteller whose voice becomes the book — often not the same person. Nothing here reduces your rights under the Consumer Protection Act 68 of 2008 ("CPA") or any other applicable law.
2 · WoordomskrywingsDefinitions
Stemme ("ons") is die verskaffer. Boek beteken die gedrukte of digitale produk wat ons uit die verteller se antwoorde maak. Koper is die persoon wat bestel en betaal. Verteller is die persoon wie se opnames die inhoud word. Bewys beteken ’n geskenkbewys.Stemme ("we", "us") is the supplier. Book means the printed or digital product we make from the storyteller’s answers. Buyer is the person who orders and pays. Storyteller is the person whose recordings become the content. Voucher means a gift voucher.
3 · Wat ons lewerWhat we provide
Ons stuur die verteller een gentle vraag op ’n slag oor WhatsApp, skryf haar stemnotas uit en redigeer liggies vir leesbaarheid — nooit vir styl nie — en lewer ’n boek met kodes wat haar werklike opnames speel. Die presiese ritme, duur en formaat verskil per produk en word op elke produkbladsy gegee.We send the storyteller one gentle question at a time over WhatsApp, transcribe her voice notes and edit lightly for readability — never for style — and deliver a book with codes that play her actual recordings. The exact cadence, duration and format differ per product and are given on each product page.
4 · Toestemming kom eersteConsent comes first
Voordat ons die verteller enige vraag vra, vra ons haar toestemming. Sonder haar uitdruklike ja begin ons nie, en die koper word terugbetaal (min ’n administrasiefooi). Die verteller kan enige tyd stop; haar besluit weeg swaarder as die koper se betaling.Before we ask the storyteller any question, we ask her permission. Without her express yes we do not begin, and the buyer is refunded (less an admin fee). The storyteller may stop at any time; her decision outweighs the buyer’s payment.
5 · Bestelling en betalingOrdering and payment
Betaling word veilig deur PayFast, Ozow of PayPal gehanteer op hul eie bladsye; ons sien nooit jou kaartbesonderhede nie. ’n Bindende kontrak kom tot stand wanneer ons jou betaling bevestig en jou bestelling per e-pos erken. Ons behou die reg voor om ’n bestelling te weier of terug te betaal waar ons dit nie kan uitvoer nie.Payment is handled securely by PayFast, Ozow or PayPal on their own pages; we never see your card details. A binding contract forms when we confirm your payment and acknowledge your order by email. We reserve the right to decline or refund an order we cannot fulfil.
6 · PrysePricing
Alle pryse is in Suid-Afrikaanse rand en sluit standaardlewering binne Suid-Afrika in, tensy anders vermeld. Pryse kan verander, maar ’n prysverandering raak nie ’n bestelling wat reeds geplaas en betaal is nie. Sou ’n duidelike prysfout voorkom, kontak ons jou voordat ons voortgaan, en jy kan kies om voort te gaan teen die regte prys of ’n volle terugbetaling te kry.All prices are in South African rand and include standard delivery within South Africa unless stated otherwise. Prices may change, but a price change does not affect an order already placed and paid. Should an obvious pricing error occur, we contact you before proceeding, and you may choose to continue at the correct price or receive a full refund.
7 · Produksie en leweringProduction and delivery

For Before We Marry we require at least twelve weeks (nine to ask, three to print and bind) and answers close three weeks before the wedding day; the machine enforces this buffer itself. We notify you if an unforeseen delay arises.
8 · Kansellasie, terugbetaling en die afkoeltydperkCancellation, refund and the cooling-off period
Elke boek word spesiaal vir jou gemaak uit die verteller se eie woorde. Onder artikel 42(2)(a) van die Wet op Elektroniese Kommunikasie en Transaksies geld die sewe-dae-afkoelreg nie vir goedere wat volgens die verbruiker se spesifikasies vervaardig of gepersonaliseer is nie, sodra produksie begin het. Voor produksie begin — of as die verteller nie instem nie — kry jy ’n volle terugbetaling min ’n administrasiefooi. Under section 42(2)(a) of the Electronic Communications and Transactions Act, the seven-day cooling-off right does not apply to goods made to the consumer’s specifications or personalised, once production has begun. Before production begins — or if the storyteller does not agree — you receive a full refund less an admin fee. Contact hallo@stemme.co.za for any refund request.
9 · GeskenkbewyseGift vouchers
Bewyse is geldig vir die minimum tydperk wat die Verbruikersbeskermingswet voorskryf — ten minste drie jaar vanaf uitreiking — en verval nie voor dié tyd nie. ’n Bewys is inruilbaar teen enige produk of teen sy rand-waarde, is nie vir kontant inruilbaar nie, en kan een keer gebruik word.Vouchers are valid for the minimum period the Consumer Protection Act prescribes — at least three years from issue — and do not expire before then. A voucher is redeemable against any product or for its rand value, is not exchangeable for cash, and may be used once.
10 · Eienaarskap van die storiesOwnership of the stories
Die stories, stemme en foto’s bly die verteller en die familie s’n. Deur deel te neem, gee die verteller vir Stemme ’n beperkte lisensie om haar opnames te verwerk, te druk, te huisves en die klankbladsy te bedien — slegs om die boek te lewer en in stand te hou. Die koper besit die fisiese boek. Stemme besit die webwerf, die handelsmerk, die ontwerp en die sagteware. Ons lei nooit modelle op haar stem op of verkoop haar inhoud nie.The stories, voices and photographs remain the storyteller’s and the family’s. By taking part, the storyteller grants Stemme a limited licence to process, print, host and serve the audio page of her recordings — solely to deliver and maintain the book. The buyer owns the physical book. Stemme owns the website, the brand, the design and the software. We never train models on her voice or sell her content.
11 · Die verteller se regte weeg swaarsteThe storyteller’s rights weigh heaviest
Die verteller kan enige tyd vra om haar inhoud te sien, reg te stel of te laat uitvee — ook ná die boek gedruk is — en daardie versoek weeg swaarder as die koper se eienaarskap van die geskenk. Sien ons privaatheidsbeleid vir hoe ons dit doen.The storyteller may at any time ask to see, correct or delete her content — including after the book is printed — and that request outweighs the buyer’s ownership of the gift. 12 · Jou verantwoordelikhedeYour responsibilities
Jy waarborg dat die inligting wat jy verskaf akkuraat is, dat jy die reg het om die verteller se nommer en enige foto’s met ons te deel, en dat jy Stemme regmatig gebruik. Jy is verantwoordelik vir die korrektheid van die afleweringsadres en van name en opdragte wat jy verskaf.You warrant that the information you provide is accurate, that you have the right to share the storyteller’s number and any photographs with us, and that you use Stemme lawfully. You are responsible for the correctness of the delivery address and of names and dedications you supply.
13 · Beskikbaarheid en fouteAvailability and errors
Ons doen ons bes om die webwerf akkuraat en beskikbaar te hou, maar ons kan nie waarborg dat dit altyd foutloos of ononderbroke sal wees nie. Ons kan die webwerf of ’n produk enige tyd aanpas of onttrek.We do our best to keep the website accurate and available, but we cannot guarantee it will always be error-free or uninterrupted. We may adjust or withdraw the website or a product at any time.
14 · AanspreeklikheidLiability
Tot die mate wat die wet toelaat, is Stemme se aanspreeklikheid beperk tot die bedrag wat jy vir die betrokke bestelling betaal het. Niks in hierdie bepalings sluit enige aanspreeklikheid uit wat nie regtens uitgesluit mag word nie — insluitend onder die VBW, of vir dood of persoonlike besering wat deur ons growwe nalatigheid veroorsaak is nie.To the extent permitted by law, Stemme’s liability is limited to the amount you paid for the relevant order. Nothing in these terms excludes any liability that may not lawfully be excluded — including under the CPA, or for death or personal injury caused by our gross negligence.
15 · OormagForce majeure
Ons is nie aanspreeklik vir vertragings of versuim buite ons redelike beheer nie — soos ’n operateur se onderbreking, ’n posstaking, of ’n natuurramp — maar ons sal jou in kennis stel en ’n billike oplossing vind.We are not liable for delays or failures beyond our reasonable control — such as an operator’s outage, a postal strike, or a natural disaster — but we will notify you and find a fair resolution.
16 · Toepaslike reg en disputeGoverning law and disputes
Hierdie bepalings word deur die reg van die Republiek van Suid-Afrika beheer. Ons wil enige dispuut eers reguit met jou oplos — skryf aan hallo@stemme.co.za. Jy behou jou reg om die Nasionale Verbruikerskommissie of ’n bevoegde hof te nader.These terms are governed by the law of the Republic of South Africa. We want to resolve any dispute directly with you first — write to hallo@stemme.co.za. You retain your right to approach the National Consumer Commission or a competent court.
